These Booking Terms and Conditions apply to accommodation bookings made with Cortijo El Aguilón.

2. Making a booking

Bookings may be made:

* through the online booking system provided by Amenitiz or other online platforms;
* by email; or
* by telephone.

A booking becomes binding once it has been accepted by Cortijo El Aguilón and the required 25% deposit has been paid, unless expressly agreed otherwise in writing. Other deposit quantities may be required for certain bookings.

The guest is responsible for ensuring that the information supplied when making the booking is complete and accurate.

3. Prices

The applicable price is the price communicated to the guest and accepted during the booking process.

The guest will be informed of the total price of the accommodation and any applicable additional charges before the booking is confirmed, in accordance with applicable legislation.

Any optional services requested subsequently may be charged separately.

4. Deposit and payment

A non-refundable deposit equal to 25% of the total booking price is required to confirm the booking.

The remaining 75% of the total booking price must be paid no later than the day of arrival, unless different payment arrangements have expressly been agreed in writing.

The initial 25% deposit is non-refundable, subject always to any mandatory rights available to the guest under applicable law.

5. Cancellation by the guest

Cancellation requests must be communicated to Cortijo El Aguilón as soon as possible, preferably in writing by email to info@elaguilon.com.

The following cancellation conditions apply:

•  Cancellation 31 days or more before arrival: The initial 25% deposit is non-refundable. No further cancellation charge will be made and the remaining 75% of the booking price will not be payable.

• Cancellation between 30 and 15 days before arrival: The initial 25% deposit remains non-refundable. An additional cancellation charge equal to 25% of the total booking price will become payable. The total cancellation charge will therefore be 50% of the total booking price.

• Cancellation 14 days or less before arrival: The full booking price (100%) will be payable. The same condition may apply in the event of a no-show, subject to applicable law.

6. Right of withdrawal

Accommodation services provided for a specific date or period are excluded from the general statutory right of withdrawal applicable to certain distance contracts under Article 103(l) of the consolidated Spanish General Law for the Protection of Consumers and Users.

Accordingly, guests do not have a general 14-day statutory cooling-off period in respect of accommodation booked for specific dates.

The cancellation conditions set out in Section 5 therefore apply, without prejudice to any mandatory rights that may arise under applicable law.

7. Changes to a booking

Requests to change booking dates, the accommodation booked, the number of guests or other material elements of a reservation are subject to availability and acceptance by Cortijo El Aguilón.

A requested change may result in a change in price.

Acceptance of a change is not guaranteed and any agreed modification should be confirmed in writing.

8. Cancellation by Cortijo El Aguilón

Cortijo El Aguilón may cancel or be unable to fulfil a booking where there is a justified reason that makes performance impossible, unlawful or unreasonable, including circumstances of force majeure, serious damage to the accommodation, essential utility failures, safety risks, government or public authority restrictions, or other circumstances beyond its reasonable control.

Cortijo El Aguilón reserves the right to cancel a booking for any reason by providing the guest with at least one month's notice prior to the scheduled arrival date. In such circumstances, any amounts already paid by the guest in relation to the cancelled booking will be refunded in full. This right is separate from any cancellation that may be necessary due to force majeure, safety concerns or other exceptional circumstances, and is subject to any mandatory rights available to the guest under applicable law.

Cortijo El Aguilón may also take appropriate action where a booking has been made fraudulently, on the basis of materially false information, or where fulfilling the booking would breach applicable law.

Any cancellation by Cortijo El Aguilón shall be handled in accordance with applicable consumer law.

​

Where Cortijo El Aguilón cancels a booking and the cancellation is not attributable to the guest, any amounts paid for accommodation that will not be provided shall be refunded where legally required.

​

Nothing in these Terms and Conditions limits any additional mandatory remedy to which the guest may be entitled under applicable law.

9. Force majeure

Neither party shall be liable for failure to perform an obligation where performance is prevented by circumstances constituting force majeure or otherwise beyond that party’s reasonable control, to the extent recognised by applicable law.

Such circumstances may include, where they genuinely prevent or materially affect performance:

* natural disasters;
* wildfire or serious flooding;
* severe weather events;
* war, terrorism or serious civil disturbance;
* epidemics or pandemics and mandatory measures adopted by competent authorities;
* government restrictions or orders;
* closure or evacuation ordered by a competent authority;
* widespread or prolonged interruption of essential utilities;
* serious structural damage to the property;
* or other comparable extraordinary and unavoidable circumstances.

The affected party must take reasonable steps to minimise the consequences where possible.

The consequences of a force majeure event, including any refund, rescheduling or termination rights, shall be determined by the circumstances of the event and applicable law.

10. Guest responsibilities

Guests must use the accommodation, furnishings, facilities and surrounding property responsibly and in accordance with any reasonable house rules communicated by Cortijo El Aguilón.

Guests are responsible for damage caused intentionally or negligently by themselves, members of their party, or persons for whom they are responsible, subject to applicable law.

The client shall be responsible for the reasonable cost of repairing or replacing any property, furnishings, equipment or facilities damaged during the stay where such damage is beyond reasonable wear and tear and is attributable to the client, members of their party, or any person admitted to the property by them.

​

The number of persons staying at the property must not exceed the number agreed in the booking unless prior authorisation has been obtained.

​

External guests and visitors who are not included in the accommodation booking are not permitted to enter or use the premises without the prior specific authorisation of the property owners. Such authorisation may be subject to additional conditions and/or charges, which must be agreed in advance.

​

Parties, celebrations, gatherings, weddings, retreats, dinners, functions and other events are not included as part of a standard accommodation booking. Certain events may be permitted at Cortijo El Aguilón subject to prior express authorisation by the property owners, specific conditions relating to the event, and payment of any applicable event or additional guest fee. The nature of the event, number of attendees, areas of the property to be used, applicable conditions and any additional fees must be agreed in advance.

Guests must respect applicable safety requirements and must not use the property for unlawful activities.

​

11. Check-in and check-out

Applicable check-in and check-out times will be communicated during the booking process or prior to arrival.

Requests for early check-in or late check-out are subject to availability and may incur an additional charge where communicated and agreed in advance.

12. Complaints

Guests should notify Cortijo El Aguilón as soon as reasonably possible of any problem arising during their stay so that the establishment has an opportunity to investigate and, where possible, resolve it.

13. Personal data

Personal data supplied in connection with a booking will be processed in accordance with the Cortijo El Aguilón Privacy Policy and applicable data protection legislation.

Where a booking is received by email or telephone, the necessary booking information may be entered into the Amenitiz booking management system for the purpose of administering the reservation and providing the accommodation service.

14. Applicable law and jurisdiction

These Terms and Conditions are governed by Spanish law.

Any dispute shall be submitted to the competent courts and tribunals determined under applicable law.

Where the guest is a consumer, nothing in these Terms and Conditions deprives the guest of any mandatory consumer protection or jurisdictional rights that cannot lawfully be waived.
